General Terms and Conditions (AGB)
Information about the content of each concert event or the services provided, as presented on our website, reflects the actual content or services provided based on the planning status at the time of document creation. This is not binding. Operational, minor changes are permissible and do not entitle you to cancel the contract or claim compensation, provided these changes do not fundamentally alter (especially worsen) the nature of the event compared to the announcements and are reasonable for you as a customer.
We are entitled to change the venue for important reasons, with the replacement venue being comparable to the Kursalon Vienna in terms of accessibility and ambiance. We will inform you by email to the email address provided during the ordering process about any such changes. Purchased tickets remain valid for the replacement venue.
The product prices stated on the order form on our website are always total prices and already include the statutory value-added tax. All prices are in EURO.
3. Event, Changes, Prices
Your order for tickets to a Sound of Vienna event is considered an offer to conclude a contract. This offer becomes binding for you once you click the [Buy Tickets] button on our website. Before pressing this button that triggers the binding contract offer, you have the opportunity during the ordering process to correct any typos in the offer. We accept your offer to conclude the contract only by sending a confirmation of the order along with the invoice attached to the email address you provided during the ordering process. You will receive either the mentioned order confirmation or notification of the unavailability of tickets within 48 hours of your order. If you do not receive feedback within these 48 hours, please inform us at sound@soundofvienna.at. If you still do not receive a response within an additional 24 hours, you are entitled to withdraw your order without incurring costs by sending an email to our address mentioned above.
2. Conclusion of Contract, Binding Effect
The "Sound of Vienna Concert Events GmbH" ("We") organizes classical music concerts and cultural events in various Viennese venues (e.g., Kursalon, Konzerthaus, Hofburg, Musikverein). We exclusively handle the ticket sales for these events. The terms and conditions outlined herein govern the details of the contractual relationship related to the purchase of tickets for these events on our website between you as the buyer and us as the seller.

Your order becomes legally effective and obliges you to pay the ticket price upon receipt of our order confirmation (see above). Subsequent cancellation is not possible.
You are required to check the order confirmation immediately upon receipt. Any recognizable deviations from the order must be reported immediately (preferably in writing, including email or fax) to us for evidentiary reasons.
Upon presentation of this order confirmation, you will receive your final ticket at the box office of the respective concert. It is emphasized that the order confirmation must not be duplicated, and we do not assume any liability for loss after delivery. The purchased tickets may not be resold without our consent.
If you provided an email address during the order, the order confirmation is considered received at that address. It is your responsibility to configure or check spam filters, etc., to ensure that the order confirmation can be delivered unhindered.
There is no replacement for unused or partially used tickets.
The right of withdrawal or revocation, according to §18 (1) Z10 FAGG, does not apply to "services (...) provided in connection with leisure activities, provided that a specific time or period is contractually stipulated for the performance by the entrepreneur," and therefore cannot be invoked for this contract. Hence, there is no such right of withdrawal for the present contract between you as the buyer and us as the seller.
Admission to the event is granted only to those who are appropriately dressed. We have the right to deny entry or exclude individuals from further participation in the event if they are obviously intoxicated or behave inappropriately. In these cases, there is no entitlement to a refund of the ticket price.
Within the booked seat category, there is free seating at concerts. At events, seats will be assigned to you within the category you have booked. Please note that it is not always possible for guests coming as a couple or group to get adjacent seats. However, Sound of Vienna reserves the right to make seat assignments within the booked category.
We are liable for personal injury caused by us and for property damage in the case of intent or gross negligence on our part or attributable persons. Our liability in the case of only slight negligence is excluded, unless this negligence concerns a contractual main obligation of ours. In the event of a cancellation, the ticket price will be refunded. However, there is no further liability on our part, especially not for frustrated travel expenses; this does not apply if the cancellation was caused by our gross negligence or intent.
Payment is made by credit card (Visa or MasterCard/Eurocard), with all transactions and order information encrypted to the latest standards, thus protected from access by third parties. The debit from your credit card is carried out immediately after the dispatch of the order confirmation.
The actual payment processing is not carried out by us but by a specialized and licensed service provider (Bókun, Stripe) in cooperation with the respective credit card providers. All data provided by the customer during the payment process (especially credit card data) is directly transmitted to this service provider or the respective credit card companies.
The personal data transmitted by you during the purchase process will be stored and processed electronically by us. The handling of the data is carried out in accordance with the GDPR. Further details can be found in our privacy policy.

The languages available for the conclusion of the contract are German and English.
Austrian law (excluding its international reference norms and the UN Sales Law) applies. The place of performance is Vienna. The court of jurisdiction for all business relationships with entrepreneurs and consumers within the meaning of the Consumer Protection Act without a domicile or habitual residence in one of the contract states of the European Economic Area (EEA), or who relocate their domicile and habitual residence to a state outside the EEA after conclusion of the contract, is the court in charge of Vienna, Inner City. If you are a consumer within the meaning of the Consumer Protection Act with a residence/habitual residence within the European Union or a contracting state of the EEA, the court of jurisdiction is the court in charge of your residence/habitual residence. However, you can also file lawsuits against us at the aforementioned court.
It is noted that there is a statutory warranty right for the purchased tickets according to §§922ff ABGB.
